This ‘Contract of Hire’ is made between Ruby Frances Bridal “Ruby Frances”, whose registered business address is 79 High Street, Minster in Thanet, Ramsgate, CT12 4AB AND “The Client”. 1.PRODUCTS 1.1All products offered are in new or pre-owned condition and all products are 100% genuine. 1.2The products are as described in the listings, however, the products may differ slightly from these photographs. By renting a product the client agrees that these photographs are only indicative of the exact quality of the product. 1.3All products are specially cleaned and maintained after each time they have been used by a client which is included within the price of hire. 1.4During the entirety of the hire period, the client will be responsible for the safekeeping of the product(s) and for keeping these goods in a reasonable state of repair. 1.5Hire products remain the property of Ruby Frances at all times. 1.6Product(s) hire period will be for 7 day as highlighted at booking. 2.PAYMENT OF ORDER 2.1Ruby Frances accept the following forms of payment: Bank Transfer, Visa, Visa Debit, MasterCard, Maestro, American Express and Cash. 2.2Clients are required to pay for 100% of the total value of the order on the date of order, which is non-refundable. 3.DELIVERY OF ORDER 3.1Delivery via postal service is an additional cost of £4.99 per product. 3.2Ruby Frances will only delivery the product(s) to the address authorized by you once full payment has been made. 3.3Each product with be sent via our nominated delivery provider on a tracked delivery service. 3.4This is a UK-based service only (including Northern Ireland), and Ruby Frances will not arrange collection or delivery to any address outside the UK. 3.5Ruby Frances is not responsible for any delays in the delivery or return of the product(s) rented or any loss or damage should the delivery information and location provided by you be unsecure or unsuitable. 4.COLLECTION OF ORDER 4.1If the client does not collect their goods by the date stated, then the ‘Contract of Hire’ will be deemed cancelled without any further notification and any monies will not be refunded. 5.RETURN OF GOODS 5.1Ruby Frances will, by the use of photography and video, record the condition of the product(s) each time it is sent and received back. This will be kept on our records and used as a comparison of condition and kept as evidence. 5.2The client must return the product(s) back to Ruby Frances within the rental period via store return or the pre-paid label provided in the delivery bag. 5.3Ruby Frances prefer that items are returned to us via our own service or nominated courier partner so that they are protected and insured. If the client decides to return the product(s) using any other third-party providers this will be at their own expense and we are unable to accept liability or responsibility for these. 5.4The client must return the original product(s) in the packaging provided on delivery. 5.5Ruby Frances reserve the right to charge the client a late fee equal to £20 per calendar week calculated from the day after the return date, until the date by which the product(s) has been returned and we have provided you with confirmed receipt. 6.DAMAGE OR NON RETURN OF GOODS 6.1The client is responsible for loss, destruction or damage to the product(s) due to mishandling, theft, mysterious disappearance, fire, major stains or any other cause. 6.2In the event of total loss or irreparable damage to any hire goods for whatever reason, the customer will be responsible for the full replacement value of these goods. It is the customer's responsibility to arrange insurance against such risk. 6.3The client is responsible for having sufficient funds available to either replace the product(s) should you lose or damage the product(s) up to the replacement value. If you are unsure what the replacement value of the product is, please contact Ruby Frances for the Replacement Value before booking. 6.4Any product(s) not returned within 4 weeks from the return date will be considered as not returned and therefore the client will be charged the replacement value of the product(s). 6.5Ruby Frances may contract a debt collector or file a claim via the courts to collect any outstanding payment that the client has refused to pay for the damage or loss have caused within the timeframe set and the charge for their service shall be added to the debt. 7.CANCELLATION OF ORDER 7.1Clients who cancel their ‘Contract of Hire’ are not entitled to a refund of any monies already paid up to and including the cancellation date. 7.2All hire charges quoted are per week and no reductions or refunds will be made after the commencement of the chargeable period. 8.LIABILITY 8.1Clients should refer to their ‘Contract of Hire’ and retain any receipts as proof of hire, and be sure to have read all ‘Terms & Conditions’, as outlined, and fully understand its requirements. Ruby Frances has such terms to protect the business regardless of your circumstances. 8.2Should Ruby Frances breach its obligations under this agreement it’s liability is limited to any direct loss incurred by the client arising from such breach. 8.3Ruby Frances will not be liable for any breaches caused by circumstances outside of the stores control including, but not restricted to, acts of god, war, riot, terrorism, malicious damage, fire, flood, or storm.
